The Court has extended the arrest of Felix Grincu despite his worsening health state
The Court has extended the provisional arrest of the activist of “Our Party”, Felix Grincu, who is in jail for the tenth month, even despite the fact that his health state worsened.
This was stated by the activist lawyer, Ion Cerga.
So, according to him, during the Court hearing which took place on July 31, the Prosecutor again demanded the extension of arrest on behalf of the activist. Cerga stressed out that the arguments for the request remained the same as used by the state Prosecutor throughout the past ten months: “he can influence the witnesses, he may commit another offence”.
The lawyer noted that the request was unsubstantiated and unsupported to any facts and this despite the fact that the legislation requires new evidence considering the request for prolonging the preventive arrest. Moreover, the argumentation of the Prosecutor’s request is generally absurd, since most of the prosecution witnesses have already been heard in Court. Cerga stated that these arguments were ignored by judges.
Meanwhile, the lawyer also points out that the health state of Grincu worsened: “pursuant to the recommendations of doctors, Grincu needs a special regime, as well as an additional medical examination”. This fact served as basis for the defense’s petition for changing the pretrial detention against the activist. However, this time the Court ignored the lawyer’s arguments.
“This case was in fact abolished by the defense. All the evidence presented by the Prosecutor does not confirm the accusation against Grincu. We consider the ongoing detention as illegal”- concluded Cerga.
It should be reminded that the activist of “Our Party”, Felix Grincu was detained on November 17 within the framework of reconvened criminal case, which was previously closed three times by decisions of Courts Centru, Riscani, and also in 2013 by the Supreme Court of Justice, which recognized Grincu as innocent.
However, it did not prevent the Court of Appeal from repealing the decision of the lower court, placing the activists under house arrest for 25 days and issuing a detention order for 30 days. Since then, Felix Grincu is still in the pre-trial detention center of the capital prison No. 13. “Our Party” considers the criminal case against the activist as politically motivated.
